(TRANS) 110218 JYJ Lawsuit, The End of Lee Soo Man’s Patriarchal Leadership by Dogsul



Yesterday, the Seoul Central District Court (Civil Cases Department 50, Chief Prosecuting Officer: Seong Joon Choi) dismissed both SM Entertainment (SME)’s objection against JYJ (Kim Jaejoong, Kim Junsu, Park Yuchun)’s provisional injunction, and SME’s injunction to terminate their management contract with C-JeS Entertainment. Though the declaratory suit is left here after judging from the decision made by the court that had dismissed SME’s objections, SME isn’t considered to have a better position in the lawsuit (coldly speaking, the judgment of the original lawsuit can be considered to have been made by over 51%)
First, Let’s look into why the court dismissed the objections.
- The exclusive contract of this case is a dominant-subordinate contract that an entertainer doesn’t have the rights in the decision-making process, and only had to follow the unilateral directions of the management company.
- Because JYJ members were in unilaterally inferior position than SME in negotiation, they had to follow SME’s measures.
The pretext, such as a decrease of investment risk or stable international expansion, cannot justify the extremely long subordinate exclusive contract like this case’s contract.
- Because not only the long-term contract but also the clauses such as SM’s command and supervision to JYJ’s every action and excessive penalty of breach of the contract intensify the subordination of this case’s contract, they are unilaterally unfavorable to JYJ members, and so they are invalid.
Giving these reasons, the court dismissed SME’s injunction to terminate the validity of JYJ members’ management contract with C-JeS Entertainment. The court granted an injunction banning SM’s hindrance to JYJ members’ independent activities in October 2009, and now made clear that SM cannot supervise JYJ members, so SME doesn’t have the chance of winning in the original lawsuit.

I think this decision brought the end to SME Chairman Lee Soo Man’s patriarchal leadership. The core of this leadership is the strategy of a hot and cold bath: as long as the entertainers are the inside of the SM fence, they can be taken best care of (even he supports the members of the group who was terminated because they were no longer popular, employing them as vocal trainers or dance trainers), but once they leave SM, they will stand in the Siberia. In this manner, he has held his entertainers.
This strategy might have been effective in order to maintain the idol-oriented large management company. Rightly or wrongly, it might. But now this strategy has passed the expiration date. Also, rightly or wrongly, it has. Now the outside of the fence is no longer Siberia. They have firm fandoms, in particular JYJ has a global fandom.
In spite of restriction on JYJ’s broadcasting activities, the sales of sound sources and albums are never behind. Despite the check of a Japanese large management such as AVEX, the OST of the drama made good profits in the Japanese market. Outside the Japanese market, SM doesn’t have friendly troops. Only is there global fans and the foreign press that will criticize the unfair contracts and violation of human rights.
Now, it’s time for SM Chairman Lee Soo Man to change the model of his leadership. Because SME is the largest management company which has twice or three times as many staffs as JYP or YG does, it has an ideal condition to make stars. In Asia, it has made “Korean Wave Silk Road” which could make Korean Wave stars. As a No.1 Asian partner of Youtube, SME is putting up a good fight. It needs the win-win strategy’ based on these abilities.
Reality is reality. Even if SM is waiting for the decision of the original lawsuit, the consequences will be more hopeless. Now SM has to draw the bigger picture and holds out its hand decisively. SM has to draw a big picture in order that “StayingXeinQui” and “LeavingXeinQui” work together in the global market by correcting the parts which the court point out, treating them as artists and suggesting proper profit sharing. This is the new leadership that is required of the industry’s No. 1 Chairman Lee Soo Man.

(NEWS) 110217 JYJ Fans Set Their Sights On Subway Advertisements


JYJ fans have set their sights on subway advertisements.

The JYJ fan alliance released detailed plans on putting up advertisements on subway screen doors that included the location of the stations.

According to the released plans, the advertisements will be placed in 21 stations, such as Jamshil, Shinchon, Hongdae Entrace, and Apgujeong over the span of a month starting from March 7th.

JYJ fans have already set up a month-long ‘We Support Your Youth’ bus advertisement that began on January 27th that brought together 120 buses in several major cities of Korea.
Fans pointed out that JYJ have been unable to appear on music programs though they have been staying active through musicals and dramas. They began the advertisement campaign to support the trio who are, according to the fans, having their activities restricted.

The money collected for the project is estimated to have been around 160 million Won and a total of 80 million Won is left after the bus campaign. This amount is to be used for the subway advertisements.

(TRANS) National broadcasting stations, what will they do about JYJ now?


Once again, JYJ has been compensated for the unfair reality by the court’s decision. The news that SM’s injunctions against JYJ have been dismissed can only delight and be welcomed by the people who love JYJ. More importantly, it was probably a decision which provided comfort and consolidation to members of JYJ themselves.

It’s an unfortunate truth that the past months have been a time full of hardships and adversity for JYJ, and the failure to ease the confrontation between JYJ and SM ENT has only brought them pity. Not many listened when JYJ tried to express their justifications for their actions. The broadcasting companies, controlled by powerful management companies, continued to prevent their appearances on national television and were beyond deplorable in their handling of JYJ’s unfortunate current situation.

The only brief appearance made was through Park Yuchun’s role in <SGK Scandal>. The drama was excellent and with his acting skills reaching beyond many people’s expectations, the viewers and the public longed to see more. However, his only appearance was just that drama. JYJ continued to be unable to appear on national broadcasts. They did appear just once in an award ceremony, but even that was for Park’s acting award, not musical performance.

Kim Junsu, Kim Jaejoong, and Park Yuchun are men with promising futures. Although being unable to carry on their activities as singers is most definitely detrimental to their bright futures, we have been unable to see them on national television. We can find the reason behind this through the influence of powerful, “unseen” forces and their reactions to the law.

JYJ wanted to give their straight and honest opinion about the “unseen force,” but found themselves blocked by obstacles every time they did so. It was probably very difficult for them to fight after escaping from the “great strength’s” sphere. Instead of trying to satisfy their greed, JYJ separated themselves and went to a group which would allow them to re-claim their rights as human beings.

The “great strength’s” sphere is so big and powerful that it often enjoys showing off its strength. Such power conspires with others like it to step on factions who claim even the smallest rights. In this current case, the issue was JYJ wishing to leave the large company SM and their will to find compensation for all the sorrowful years they’ve been forced to endure.

The courts have sided with JYJ’s demands because there is credibility with what they are asking. However, knowing that if they were to let this pass more similar events may occur, the large management companies decided to foolishly refuse to allow JYJ go free and instead are walking towards their own destruction by endlessly opposing the courts’ strict rulings. Amongst this, the national broadcasting stations are trying to read the situation and to not get sucked into the fighting.

However, the situation has now changed. Broadcasting stations, who have simply been reading the situation, should now be done. The dismissal of SM’s injunctions showed that JYJ’s case is completely legal.

If we think well about them, the broadcasting companies’ position were that of a bystander. However, they no longer have a reason to deny JYJ from appearing on their broadcasts. The fact that JYJ can’t appear on national television is an almost comical pity in the current time period. Now, with many deciding that it is time to end such an era, the broadcasting companies must quickly arrive at their decision . They must side with JYJ because the laws now protect their claim of independence from SM.

With the current ruling, the national broadcasting stations should no longer have reasons to reject JYJ. The courts have accepted the illegality of SM’s contract with JYJ, and have even allowed them to reclaim their decision-making power. The courts have sided with JYJ’s claim of being bound by an illegal contract which did not allow them to express independent ideas, and, at the very least, this provides the reason on why they should be allowed to freely perform on all stages.

Even if JYJ received investments while being a part of DBSK, the courts’ ruling that excessively binding contracts cannot be justified should provide an important chance to protect rights of other weak idol stars. JYJ, at the very least, have contributed greatly to their company’s profits while working under their name.

SM has done enough damage to JYJ despite their past contributions to the company. You cannot find any sort of justification for further victimizing the victim who left because he could endure no more. Now the only decision left is those that need to be made by the national broadcasting stations. Even if they were simply the bystanders of this situation, they should no longer stand in the way of JYJ appearing on stages for national audiences. I hope for the broadcasting companies’ courageous decision to cast JYJ for their programs. As a person living in this era, I wish for the victory of justice and righteous choices.

[News] 110217 JYJ to hold large-scale fan meeting in March‏




JYJ will be holding a 3 hours fan meeting on the 12th of March at Seoul Jamsil Stadium.This fan meeting will be held before the White Day and was said to be set up according to “A Sweet White Day Date”. It has been 4 months since the concert last November that JYJ has met the fans.

This fan meeting will be themed into “Encounter”, “Attraction”, “Intimacy”, “Confession”. JYJ members have prepared their solo stages and designed it to have interactions with the fans.

Additionally, JYJ has personally invited special guest to this event and it was anticipated to have an interesting talk.

Park Yoohwan confessed that he started his acting lesson together with his older brother JYJ Park Yoochun. Previously Park Yoochun was involved in ‘SungKyunKwan Scandal’ drama and while he was learning his acting for the drama, Park Yoohwan learned along with him.

Park Yoohwan said, “Hyung has a lot of broadcasting experiences, thus he’s full of confidence. Meanwhile I didn’t even know there were 1, 2, 3 cameras. I was terribly nervous because I knew nothing.”

Eventhough Park Yoochun was a rookie as an actor, but he’s given many difficult and crucial lines. The drama later also received good reviews and shook deeply many women’s hearts. The brother furthermore mentioned that Park Yoochun even occasionally speak in the same tone as his drama character when he’s at home. “When he’s at home, he likes to speak in the same tone as Lee Seon-jun. Even his behavior often turns just like his role in the drama. Usually hyung as an entertainer is not the same as him at home.” Park Yoohwan explained.
While learning acting along with his brother, Park Yoohwan started to dream to become an actor. But it was not easy. When Park Yoohwan was watching Park Yoochun acting in ‘SungKyunKwan Scandal’ he thought, “I can do something like that too.” without belittle the hardships of becoming an actor. Fortunately through an audition he finally gets a chance to actually start his own acting career. Park Yoohwan is currently casted in new MBC weeked drama ‘Shiny Shiny’ as role Lee Seo-woo.

Lee Seo-woo is a man who had experienced trouble while was living in United States. Yet as a man he keeps the pain in his heart, and doesn’t show his feeling in the outside. Park Yoohwan said, “Lee Seo-woo is the same character as me. He lived in United States and suffered the pain of discrimination. At home together with his family he’s a bright child, but in the outside he lived a painful life.” He expressed confidence in his character representation.

Still Park Yoohwan insists that he wants to learn acting even more thoroughly in the future. “One day I want to stand on the same stage with Park Yoochun hyung. Even if our characters become in rivalry setting, I think it’s going to be interesting. But of course I want to be the role who wins over him,” he jokingly said with smile on his face. But then with a determined expression he stated, “I want to win against hyung through acting.”

JYJ, formed by three former members of boy band TVXQ, are now officially on their own and no longer under the influence of their former management agency SM Entertainment. 

The Seoul Central District Court on Thursday dismissed a lawsuit filed by SM Entertainment against JYJ over what the band said was an unfair contract between the two parties. JYJ asked the court in 2008 to suspend the contract, and the court agreed, but SM Entertainment brought an injunction. 

The band said their 13-year contract with SM Entertainment was unjustifiably long and it prevented them from receiving a fair share of the profits they generated. Since then, they have separated from TVXQ and created JYJ, which is shorthand for their names -- Jae-joong, Yu-chun, and Jun-su.

Hong said that Yoochun and Junsu came for the physical exam. He's not really interested in male idols, so it was so so for him to see them in the beginning. But as he observed Yoochun and Junsu more, he realized that they were very kind and polite unlike other entertainers. They didn't say no to people who asked for autographs and signed the autographs w/ a smile on their face. Also, they talked to other people around them. When they were finished w/the exam, they smiled and greeted every single staff members at the Administrations office. Hong added that they were also very funny.

Hong said he's not a JYJ fan, but his stereotypes about entertainers were gone after meeting with JYJ. Hong said to Yoochun, "You're so kind unlike other entertainers". Then Yoochun said, "No, I'm not, he he, thank you for your hard work." Hong added later when Yoochun and Junsu got in the car to leave, they even opened the window to greet people 1 last time and smile at everyone.

Hong concluded that Junsu and Yoochun were not just popular celebrities but they had great personalities and wished them the best for their activities in the future.

Seoul District Court dismissed SMEs cases against JYJ

This is the full text of press release from Sejong Law Firm regarding the court’s decision to dismiss all cases filed by SME. This was released today, on February 17, 2011. Now the broadcasting companies cannot use this provisional injunction as their excuse to keep JYJ from air!

1. On February 17, 2011, the Seoul Central District Court has dismissed
  1. SM Entertainment (SME)’s objection against the provisional injunction that Jaejoong Kim, Junsu Kim and Yuchun Park applied, and 
  2. application for injunction to terminate their contract with C-JeS Entertainment. 

The court (Seoul Central District Court Civil Cases Department 50, Chief Prosecuting Officer: Seong Joon Choi) dismissed an objection against JYJ’s provisional injunction, and SM’s injunction to terminate their management contract with C-JeS Entertainment.

2. Court clearly confirmed again that its decision, that the former contract between JYJ and SME is invalid, thus JYJ shall be fully assured of independent activities in the entertainment business, is legitimate. Moreover it is confirmed that SME cannot hinder JYJ’s entertainment activities insisting on the validity of this contract.

(1)  SME insisted that the court’s decision (that SM cannot hinder JYJ’s independent activities in the entertainment business) was illegitimate and applied for a provisional objection against it.

Regarding this, the court decided that ① this case’s exclusive contract is ‘a subordinate exclusive contract’ because the artists could not claim their rights in the decision-making process and only had to follow the management’s unilateral directions, ②JYJ had to obey SME’s measures because they were in unilaterally inferior position than SME in negotiation, ③ this extremely long subordinate exclusive contract cannot be justified under any circumstances such as overseas expansion or a decrease of investment risk and ④ it is invalid not only on the account of exceptionally long term of the contract but other clauses such as interference in JYJ’s every action and excessive penalty of breach of the contract.

(2) Also regarding SM’s provisional injunction to terminate the contract between JYJ and C-JeS Entertainment, the Court judged that: ① since it has been already established that SME cannot hinder or interfere with JYJ’s independent activities in the entertainment business according to the court’s decision on October 27, 2009, SME’s injunction that directly goes against this decision cannot be allowed, and ② SME’s application of the provisional injunction shall be dismissed on similar grounds, making it clear that SME does not have any authorities to JYJ’s contracts for entertainment activities at the present.

(3) Therefore, this ruling reconfirmed that SM cannot disturb JYJ’s own activities or insist the validity of its contract. Because the exclusive contract between JYJ and SM has been judged invalid by the Court as well as it cannot be legally recognized under our [Korean] law.

이에 대하여 법원은, ① 이 사건 전속계약은 연예인이 자신의 독자적인 의사결정권을 가지지 못하고 연예기획사의 일방적인 지시를 준수하도록 되어 있는 ‘종속형 전속계약’에 해당하고, ② JYJ의 멤버들은 협상력에 있어 SM에 비하여 일방적으로 열악한 지위에 있어 SM의 조치에 그대로 따를 수밖에 없었으며, ③ 투자위험 감소나 안정적인 해외진출 등의 명분으로 이 사건 계약처럼 극단적으로 장기간의 종속형 전속계약이 정당화될 수는 없고, ④ 장기간의 전속계약기간 이외에도 SM이 JYJ 멤버들의 일거수일투족에 관하여 지휘•감독권을 행사할 수 있는 조항이나, 과도한 손해배상액 조항도 모두 이 사건 계약의 종속성을 더욱 강화하여 JYJ 멤버들에게 일방적으로 불리한 조항에 해당하여 무효라고 선고하였습니다.

(2) 또한 SM이 JYJ 멤버들과 씨제스엔터테인먼트 사이의 계약의 효력을 정지하여 달라는 가처분 사건에서 법원은, ① 법원이 2009. 10. 27.자로 SM에 대하여 JYJ 멤버들의 독자적인 연예활동을 방해하지 말 것 등을 명하는 가처분을 한 사실이 분명한 이상, SM이 JYJ 멤버들과 씨제스 엔터테인먼트 사이의 업무위탁계약의 효력까지 정지하여 줄 것을 구하는 것은 위 가처분결정에 정면으로 반하는 신청으로 허용되지 아니하며, ② 현재로서는 SM이 JYJ 멤버들의 연예활동에 대하여 전속계약에 기한 관리•감독권을 행사할 수 없다는 점을 분명히 하고, SM의 신청을 기각하였습니다.

(3) 이로써 SM과 JYJ 사이에 체결한 전속계약은 무효이고 우리 법률상 인정될 수 없다는 점, 따라서 SM이 JYJ 사이의 전속계약이 유효함을 주장하며 JYJ의 독자적 연예활동을 방해하여서는 아니된다는 점이 다시 한 번 분명하게 법원을 통해 확인되었다고 할 것입니다.

[UPDATES] Seoul Central District Court dismisses both of SME’s injunctions against JYJ

On February 17th, the Seoul Central District Court dismissed both lawsuits filed by SM Entertainment against JYJ.


To recap, SM Entertainment filed an objection on October 27th, 2009, claiming that the Seoul Central District Court’s order to prevent them from interfering with JYJ's individual activities was illegal.

The court rejected SM’s injunction objection application by stating, “The exclusive contract between SM and JYJ forces the celebrity to become subordinate to the agency without any discretion. JYJ has no option but to follow SM’s actions due to the subordinate rank they are forced under in the power of SM. A long-term subordinate contract cannot be justified by the risks the agency took in investments, as well as international advancements.

They continued, ”Aside from the long-term contract terms, SM’s ability to supervise and direct every move made by JYJ, as well as the clause claiming that JYJ must repay for losses only emphasizes the subordinate positions of JYJ in the contract, so the injunction is invalid.

Regarding the second injunction filed by SM Entertainment, asking the court to suspend JYJ's contract with C-JeS Entertainment, the court replied by saying that the injunction is invalid since SM Entertainment was ordered on October 27th, 2009 that they were to not interfere with JYJ’s individual activities, and their injunction was in breach of that order.

Baek Chang Ju, CEO of CJES Entertainment, commented, “We consider it a victory of truth and hope that their activities are no longer hindered by forced accusations of double contracts. We will be working hard to show only the best side of JYJ to the public. I would like to thank the JYJ members and the staff for consistently battling a tiring fight against Goliath.

In conclusion, the exclusive contract between SM and JYJ is invalid, and JYJ’s individual activities are legal.


[UPDATE #1]

Representatives of SM Entertainment stated in the aftermath of the ruling, “The legal battle between SM and JYJ is not yet over. This court decision is merely regarding a preliminary injunction, this does not mean that the exclusive contract between SM and JYJ is invalid. The original lawsuit is still ongoing, and the date of pleading will be sometime in mid-March. Through the original lawsuit, the truth will be investigated, and we will be working to make sure that their contracts are still valid.

[News] Controversy over JYJ’s late physical for military conscription? MMA says “It’s because of their stay in foreign countries”

Hope this article clears up some confusion about the recent physical JYJ had to take for Korea’s mandatory military service. :)

Recently there has been a lot of interest over JYJ receiving their physical for military conscription now in their mid-twenties.

[In Korea, men are supposed to receive their physical check-up for Korea’s mandatory military service when they turn 19 so JYJ’s recent check-up is quite late in this respect]

Men are obliged to receive the physical checkup when they turn 19 years old, but JYJ has postponed it for nearly five years, raising the controversy that they may have received special treatment for being stars of the Korean wave.

However, according to Seoul’s Military Manpower Association (MMA), JYJ postponed their physical due to lawful reasons—their frequent stays in foreign countries.
