It has been found that the side for group JYJ (Xiah Junsu, Hero Jaejoong, Micky Yoochun) has withdrawn the petition it filed against TVXQ’s Japanese agency Avex in Tokyo District Court alleging interference with holding a concert.
Avex revealed on the 2nd through its official website that “on May 27th of this year (JYJ’s management agency) C-JeS Co., without having waited for the court decision, itself withdrew the legal action.”
Avex interpreted the withdrawal by C-JeS as follows: “Avex had felt certain that it would receive the judgment of dismissal (of the C-JeS petitions) from the court. It seems that C-JeS Co. believed that to maintain the above petitions any further was difficult and so gave up the petitions.”
Avex has in the past strongly objected at the time of the (filing) of the suit that: “The charity event for the Japanese earthquakes were planned without the permission of Avex that has the exclusive management rights of JYJ and we had only made a just and obvious response to the infringement.”
C-JeS had petitioned for an injunctive judgment to the courts on the issue of the cancellation of the charity event relating to the Japanese earthquakes saying that “the response of Avex to interfere with the holding of the concert is unjust,” along with Zak Corporation which is the hosting company of the event.
Prain, which is in charge of JYJ’s promotions, answered with regards to this withdrawal: “The filing of the petitions was done in the form of a protest because the interference of Avex for JYJ’s Japan concert was so severe. However, because it has now become possible for JYJ to perform in Japan on the coming 7th, it was decided that there is no longer a need for the petitions, and that is why the petitions were withdrawn.”
