2011.3.14 Cjes and Zak formally conclude/signed a concert contract. Cjes and Zak agree to split the balance 50/50 after expenses are subtracted from the concert proceeds as their profit. [Cjes is to donate their portion of the profits to charity.]

2011.3.23 Attorney for Avex sends Zak content-certified mail* protesting and warning against holding the concert

2011.3.30 Zak receives notice in Yokohama Arena’s president’s name that they cannot grant permission [for JYJ] to use the Arena

2011.5.18 Zak signs a pledge to JSA stating “We promise to solve the problem between C-JeS Entertainment Co.,LTD and Avex Group Holdings concerning JYJ’s exclusive contract entirely by Cjes and Zak without involving the Japan Sumo Association in anyway, so please allow us to use Kokugikan on June 7th.”

2011.6.2. Avex sends content-certified mail to the Chairman of the JSA demanding cancellation again

2011.6.3 JSA makes inquires to the Tokyo Metropolitan Police Department Organized Crime 3rd Department as to whether Zak has ties to organized crime and receives the answer that there are no ties. They also make inquiries to the National Center for the Elimination of Boryokudan database and come up with no ties.

2011.10.5 Attorney for JTB sends Avex content certified mail “We have received your warning and have decided to resign from the executive committee of the event stated above. Our resignation from the executive committee has been formally accepted in the meeting of the committee on Sept. 30 and we have notified all the parties involved.  <omitted>  In your notification to us you stated that we were the company in charge of organizing the event mentioned above. However our position in the executive committee was administrative office so we believe that your statement that we were the organizing company is incorrect.”

The below is from records of the trial between C-JeS Entertainment and Avex Management at Tokyo District Court. (Trial Material for Civil Section 29. 2011(ワ)No.17612, Plaintiff : C-JeS Entertainment, Defendant : Avex Management Document prepared by C-JeS Entertainment on Oct. 19, 2011)

The “attorney for the plaintiff” mentioned here means the attorney representing C-JeS in the trial at the Tokyo District Court.

“On Sept. 22, 2011 the attorney for the plaintiff [T/N: attorney for C-JeS in Japan] received a call from Attorney Jihye Shin who is representing JYJ in Korea saying “We received a request from SM for reconciliation for both the trial in Korea and Japan. However we find it difficult to understand their true motive in making this request.”

Recently in the lawsuit in Korea concerning the validity of the exclusive long term contract between management companies and artists, the Supreme Court ruled that long term contracts between management companies and artists are invalid, signifying there is a high chance that the Korean court will rule in JYJ’s favor in the lawsuit between SM and JYJ. It can be presumed that SM, because of this turn of events, decided that it would be better to resolve the lawsuits in both Korea and Japan at once by reconciliation. Also, the request made by SM to Attorney Shin assumes that the defendant [T/N: Avex Management] will follow SM’s instructions. Therefore it is easy to presume that the defendant is obstructing the management of JYJ in Japan out of concern for the wishes of SM.”

[TRANS] 111012 Newspaper Refuses to Carry Advertisement for JYJ Concert! The Opaque Reasons

The JYJ concert “2011 JYJ UNFORGETTABLE LIVE CONCERT IN JAPAN” will be held this weekend at the National Hitachi-kaihin Park in Hitashinaka, Ibaraki. But behind the scenes the activities of Junsu, Jaejoong, and Yoochun, the three who left Tohoshinki, were met with more trouble.

As a result of the break up and contract troubles, Changmin and Yunho have activities. Their management company Avex formerly managed the three members of JYJ and the three had concerts. However Avex unilaterally announced the suspension of the activities of JYJ in Japan citing JYJ’s Korean management company’s ties to the mafia.  JYJ protested this decision claiming that Avex knew about this when signing the contract. (T/N: This article misreports in that C-JeS never had mafia ties but its CEO, Mr. Baek, did have a prison record of which Avex was well aware from the very beginning.) The three resumed activities with the support of another company. However the two companies are still in dispute over the contract.

“A fan pleaded to the CEO of Avex, Masato Matsuura on twitter to stop obstructing JYJ’s activities. He replied ‘This is not obstruction. It’s a contractual problem. In other words a promise,’ revealing his intent to keep fighting. Avex requested sports newspapers and other media outlets to stop reporting on JYJ and as a result the name JYJ has practically disappeared from most media.” (Reporter for a sports newspaper)

Although it has been ignored for the most part by the media, both sides have been battling fiercely. There was a case when JYJ tried to hold a charity concert sponsored by the new company, but the arena canceled under pressure from Avex.

This time another incident has caused shock waves among fans.

“JYJ fans, worried that the media was ignoring JYJ, gathered donations to place an advertisement for JYJ’s concert in the Ibaraki Newspaper. The Ibaraki Newspaper was also positively considering publishing the advertisement. However, suddenly, just before submitting the manuscript, the fans received a call from the newspaper informing them that the advertisement had been canceled.” (Reporter for a weekly magazine)

The cancellation happened after the advertisement’s size, price, and wording had all been confirmed. The reason given was “JYJ is in the midst of a lawsuit” “Their concert has been canceled before”, and “The venue has received a call protesting against the concert” and as a result it was decided that the JYJ advertisement did not meet the newspaper’s requirements.

Enraged fans responded angrily “They knew about the lawsuit from the beginning” “Is this harassment from Avex?”

We asked people at the Ibaraki Newspaper about details of the cancellation of the advertisement.

“We have been sued in the past because of what we published, so the fact that they were in the midst of a lawsuit was the biggest problem for us. But although this decision was made after much discussion, personally I feel troubled by this cancellation. This was a very unique and good opportunity where ordinary people were supporting the artist but …”

The newspaper has denied that they were pressured by Avex. However the weekly magazine reporter points out that the result is that Avex wins.

“If the reason that the advertisement was cancelled was because of the lawsuit, that means that Avex’s negative campaign worked. The credibility of the artist is notably damaged and they are very limited in their activities just because they are in the midst of a legal dispute.”

How long will this situation of not being able to support JYJ even from the shadows continue? The fans who initiated the advertisement say that the money gathered for the advertisement will be pooled and used for another JYJ support project in the future. How will this fight end?

[Trans/Summary] Avex sues the venue that held JYJ’s Japan Charity Concert

Summary of the article in “Shukan Gendai” –Weekly times- Newspaper

On the 10^th of May, a warning was sent to the Sumo Organization, clearly requesting the suspension of the event.

Then, a representative from the side of the Sumo Organization called on the 12^th of May, saying “figure out your trouble between the involved parties (T/N: JYJ and Avex) because we’ve already allowed the use of the venue, and received the rental fees” the representative informed them rudely. (T/N: the quotes from the representative were written in informal speech that can be considered rude when spoken in such a formal situation.)

“Right before the concert on the 2^nd of June, we sent them another warning, but it was useless” a person from Avex said. Avex took all the temporary methods to stop the concert but, it is now forced to take legal actions against the Sumo Organization, the management company and others seeking compensation of 143,400,000 Yen (T/N: approximately $1,834,200) and is taking the case to Tokyo district court.

The compensation was estimated based on the calculation of the profit that Avex would have gained if they held the event as the management company. “All the other concert venues in Japan knew about the trouble between us and the Right-wing gangster organization, and refused to host the concert.

Why was the Kokugikan (T/N: sumo hall) the only one to accept them? You start to suspect that they have connections to the other side (T/N: Right-wingers)” says a member of Avex management.

Concerning this lawsuit, the Sumo organization stated, “The petition for the lawsuit has not been confirmed yet, therefore we cannot answer any questions”

For a sumo organization who is covered in scandals and barley managing to finally hold a tournament, the opportunity of hosting a concert for such a popular idol group was an irresistible temptation, but the final result was that they made an enemy of such a huge recording company.

The CEO of avex, Mr. Masato Matsuura’s twitter is under fire, and he is forced to shut down his twitter.

There was a suspicion that a Chinese singer stole a song composed by Jaejoong (ex-member of Tohoshinki, currently a member of JYJ). There was a rumor on the internet that it was an act of Mr. Matsuura (and those around him). In regard to this, Mr. Matsuura said on the 17th that “I don’t have anything to do with it, and I don’t know anything about it. But there are those who send me childish complains anonymously, selfishly misunderstanding the situation. It sucks, and also lame… This time, we are the victims. And receiving slander comments continuously, he tweeted, “There is no meaning doing such things, so I will be off from twitter, excluding the time I’ll be uploading my photos!”
After that, his followers sent “Please do not quit”, but he responded by “But, some jy (T/N: twitter user’s account name) said I should quit (Lol)”. Some of the fans on twitter exploded their anger.　”Don’t call the group name like that, you are the CEO” “Keep in mind of your position”. They also send other attacking comments, and Mr. Matsuura’s twitter became an exchange of words, and thus, under fire. Mr. Matsuura responded to many comments of his followers saying “I cannot leave this untouched.” Afterwards he tweeted “Thank you for everything up to today. There are stupid persons like me (Lol). I am happy that there are those who understood a stupid person like me, and also, understood somewhat of my few good points, too. So,for the time being, good bye” “So, see you!”

There are contractual problems between avex and JYJ, and there are various conjectures on the internet concerning avex and JYJ.
