[Trans] 111019 JYJ · KBS “Music Bank” Appearance Battle Enters Round Two


The battle between JYJ and KBS to appear on broadcasts have entered round two.

KBS is still maintaining a conservative stance on the appearance of JYJ. After announcing their stand for a second time this May, they now cite the fact that JYJ is “currently involved in a lawsuit” as the reason, the same viewpoint that they had mentioned in May.

In May this year, KBS, in response to the audiences on why JYJ was unable to appear on Music Bank, expressed that “JYJ is currently doing artist activities while having two contracts, and we have decided that allowing them to appear on broadcasts in such a situation would potentially interfere with the progress and order of our cultural industry”

Following that, JYJ expressed, “The courts have ruled that JYJ’s contract was unilaterally unfair, and ruled that contract to be nullified,” and requested that KBS change their stance, but KBS removed the earlier message, and then announced that “JYJ did not officially release and album, and therefore is unable to appear. When the album is released, they would of course be able to enter the charts,” changing their official stance.
However, recently JYJ released their official album, but were not allowed on “Music Bank,” and were unable to enter the charts as well. On the message boards, audiences have been leaving an increasing number of comments on this issue.

Following which, KBS announced, “With the official album and the temporary injunction, the situation has changed, but so far the injuction as well as the effectiveness of the various exclusive contracts, compensations and various lawsuits are still underway, and these have nothing to do with the ruling of the temporary injunction. We maintain our stand on the appearance of celebrities currently involved in a lawsuit,  and until a conclusion is reached, we will continue to monitor the situation’s progress,” reiterating their stand.

The JYJ side once again protested. JYJ’s management company said, “KBS’s denial of their official reply to the public which was made in May, which was uploaded onto the message boards, is very regrettable. We have very strong objections to this reply on the message boards.”

They also said, “Despite JYJ being in the midst of a lawsuit to correct the unfair contracts that violates the artists’ rights, the courts have twice sanctioned JYJ’s activities despite the lawsuit. If KBS maintains their above position, then we would like them to present evidence that all appearing artists have been evaluated with the same standards.”

They stressed that “If KBS respects the sanctity of the court’s decision, then please protect JYJ’s freedom to do their artist activities, as ruled by the court. We feel that this should be the true responsibility of KBS.”

KBS recently announced that JYJ can’t appear on their Music Bank.

On the 18th, the program posted a note on their official homepage, “Entertainers, who is in litigation, can effect the result of the lawsuit if they appear on TV. We will watch the development of the events and then we will decide about their appearance.”

Since JYJ is currently in litigation, KBS will not allow JYJ to appear on their programs until the result come out.

When fans asked Music Bank about JYJ’s appearance in May, the program officially said, “JYJ couldn’t appear on the show because they didn’t release their official album. If they release their album, they will enter the chart as a matter of course.” However, KBS didn’t keep their promise.

On the 19th, JYJ’s agency says, “We feel sorry that KBS didn’t keep their promise to the public.”

The agency adds, “As we said before JYJ is in litigation about unfair contract but the court ruled JYJ should be guaranteed with their entertainment activity. KBS should present proof about their fair judgement of appearance to all the entertainers. We think if KBS respect the court’s judgement, they have to follow what the court said.”

JYJ released their first Korean album In Heaven and over three hundred fifty thousand albums have been sold. JYJ will hold their exclusive concert in Spain on the 29th.

JYJ Raises Objection to Its Omission from the Music Bank Chart. “Please Fulfill Your Responsibility to Be Fair.”

On the [lack of] appearance and omission from the rankings of JYJ from KBS 2TV’s Music Bank, the two sides are again in conflict.

JYJ has recently released its first Korean-language album and is gathering a good result from the digital music and album charts. JYJ’s In Heaven has sold 165,000 copies cumulatively on Gaon Chart and the agency’s records show that it has broke 350,000 in total. At this, JYJ fans raised an en-masse objection to the fact that JYJ has been omitted from the KBS 2TV Music Bank Chart.

According to the Korea Communications Commission, Music Bank revealed: “because TV appearances and such by an entertainer who is in the middle of a lawsuit may affect the outcome of the lawsuit, we will examine whether the entertainer may appear or not while keeping tabs on the development of the situation.”

Continuing, it explained: “Currently, apart from the result of the petition for injunctive relief, there are many main suits for instance on the validity of the exclusive contract and damages. There is no change to our position that fundamentally we will postpone the appearance of the entertainer who is in the middle of the lawsuit regardless of the result of the petition for injunctive relief and that we will monitor the situation until the results are finalized.

Music Bank added: “Although the situation keeps changing such as through the release of the regular album and the content of the petition for injunctive relief, the main lawsuit between SM and JYJ is continuing still and the court is still not giving the final decision and so the position taken by the Music Bank staff has no significant changes from before.”

This is a changed position from Music Bank’s position from last May, at which time it replied on the viewers bulletin board to a question that asked the reason for JYJ’s impossibility of appearance: “Currently a legal/lawful decision has been issued. However, because JYJ has not released a regular album, the appearance on TV is difficult. JYJ has not released an official album, e.g., an OST, and so it is not a candidate for charting. If in the future an album is released, under the discussion of the production team of variety programs including Music Bank, whether they can appear or not will be examined.”

At this, JYJ revealed its position: “KBS, as a public/government broadcast station, should have fair standards. But it has posted on the bulletin board content that denies its official answer that made a promise with the public and the media last May. We think this is unfortunate.”

Continuing, JYJ continued: “We have repeatedly informed you of this. JYJ is engaged in a civil lawsuit that re-establishes the human rights of artists with regards to unconscionable/unfair contracts. The court has twice issued the decision that one must ‘guarantee JYJ’s entertainment activities during the duration of the lawsuit.’”
JYJ argued: “If KBS will adhere to this official position, then it shall need to present evidence that it is deciding with the same standard for all entertainers who currently appear on broadcast when deciding whether s/he can appear. If KBS respects the sacred decision of the court, then we think it is right that it fulfill the decision of the court that calls for the guarantee of JYJ’s free engagement in entertainment activities and fulfill its responsibilities as a fair institution.”

[INFO] Now that JYJ Has a “Regular Album” Out, KBS Reverts to Its Former Excuse to Ban JYJ from Music Bank

Korea Communications Commission is an executive branch dealing in broadcast communications similar to the FCC of the United States (source: Wikipedia). A JYJ fan has sent the commission an inquiry with regards to KBS situation. KCC in turn asked KBS and forwarded its reply to the fan. We provide the translation of the response below.

In short, now that JYJ has released the “official regular album” and thus this excuse no longer works, KBS reverted to its previous excuse to unsurprisingly keep banning JYJ from Music Bank. If KBS will be irrational, then the least it can do is to be consistent and thus ban both sides. After all, there are two parties to this lawsuit. 

Hello. We are the Korea Communications Commission. We thank you for the interest and participation for the healthy development of broadcast communications.

As for the items that you have informed us we have requested the broadcast station in question to cooperate to confirm (the facts) and to take appropriate measures. We forward you the reply from the broadcast station as follows.
